Why Sign a Buyer Agency Agreement?

In the past, real estate agents represented only sellers. With the advent of Buyer Agents, agents can now represent the buyer.

If you are a buyer, a Buyer Agent is your advocate and binds the agent to you and you to them. By signing an Buyer Agent contract, your agent is legally accountable to you, not to the seller. Your Buyer Agent can™t divulge confidential information to the seller nor to the seller’s agent nor to any other agency or vendor, e.g. real estate agency, mortgage lender, insurance company, etc.

Signing this agreement costs you nothing. A Buyer’s Agent is paid a commission by the seller on the house you buy. Why not have the representation that a seller has at no cost to you? If you work with a real estate agent and haven™t signed an agreement you may have cheated yourself out of full representation. Without a signed agreement, your real estate agent is working as a Facilitator and is not legally bound to either buyer or seller.

A Buyers Agent agreement allows your real estate agent to work with you on:

  • Locating properties on the market using Multiple Listing Service (MLS), For Sale By Owner (FSBO) or any other source;
  • Suggesting a mortgage provider;
  • Suggesting a lawyer;
  • Suggesting vendors that could help you evaluate property, e.g. house inspector, structural engineers, etc.
  • Previewing properties for you;
  • Evaluating properties under consideration to comparable properties in the area;
  • Advising you on price;
  • Providing negotiating options;
  • Preparing a purchase offer;
  • Delivering any purchase offer promptly to the seller or the seller’s agent;
  • Negotiating on your behalf;
  • Arranging inspections, warranties, and any certifications that might affect the value of the property;
  • Accompanying you on a final property walk-through before closing;
  • Attending the closing and provide assistance to you and your attorney at the closing.
